New WD black not working (failed to initialize due to i/o error)

got a new drive from newegg, not sure if i can return it as i dont have the original plastic it came in,

drive failed to initialize due to I/O error
used WD data lifeguard and shows too many bad sectors.

anything i can do about it? First WD drive and this is what happens lol
