WD Elements 1TB USB3.0/2.0 only connects as USB 2

Just bought a new WD Elements USB3.0 drive to make use of the USB 3.0 ports on a new Dell E6530 but it will only connect at USB 2.0 and gives a message in devices saying “the device can perform faster if connected to a USB 3.0 port”.  But it IS !! The laptop is running Windows 8 64bit

I’ve tried to update the driver but Windows says it is up to date which I can’t believe since its dated 21/6/2006

Check if you have the latest USB 3.0 drivers for your laptop.

Already checked the WD website which has no drivers available for download.

It states specifically that the appropriate driver will be made available via the operating system - in this case Windows 8

However, I’am suspicious as the driver it has installed is dated 2006 which does seem strange for a USB3 device ?
