My passport 1 tb is often get into "not responding" mode

my  ‘my passport 1 tb’ often getting into ‘not responding’ mode. sometimes it does not even detected by my system. by using wd drive utilities provided by the hdd sometimes it does not even passed smart status. now the drive is barely 10 days old. what to do?? 

i have almost 320 gb of data in it. so format is not an option if & only if nothing other option is available and it surely solves the problem forever. or i should replace it and demand a new one??

If the drive did not pass the test you can return to the store, if possible then process an RMA.

i have purchesed it from Amozon.in, and i have a wd customer centre in my city… can i return the product to them and wait for a new one??
