Class action on DL4100 failures?

The cases of the failed DL4100 is staggering, but what is more staggering is unwillingness of WD to resolve the issue for the existing out-of-warranty users. Now a lot of us a left with the useless piece of junk with no easy way to recover data and to switch to another NAS (another brand, of course, I don’t see any point to stay with WD after such disaster).

Do you think it could be a good basis for a class action against WD?
