Portable Disk - WD My Passport Problem

I recently bought a WD My Passport (500g) USB 3.0 portable disk and am having 2 curious problems with it.

Under Windows 7 Home Premium the I have the following 2 problems.

1. When I plug it into a USB 2 port, I get a message saying that it could perform faster if it were plugged into a USB 2 port. I wouldn't be surprised if it said a USB 3.0 report.

Most Important though is the following:

2. If I open the disk to view the contents and close it several times then try to 'safely remove' it I get a small window whose title says Problem Ejecting USB Main Storage Device with the reason given is The device is currently in use. Close any programs, etc.. If I immediately, without closing that window, try to safely remove it using the little USB icon it the Safe to Remove message appears.

I do not have a USB 3.0 card installed yet.  I want to get the disk working smoothly on USB 2.0 before taking that steip

Other than that, the disk seems to work just fine. Anyone have any thoughts how to correct this situation?
