My Book Live - Failed both short and long tests

My Book Live failed both short and long tests even after restoring it to factory setting. Here is what i am getting, can someone help me in finding the problem and how I can fix it?

How long does it take for support to get back to you? They say 24 hours but I’m going on 72 with not a word and I’m in a similar situation… drive is failing both tests and only working intermittantly.  I really need some help on this one - my data is important.  How long do I have to wait before I can call without being charged?

I got a reply in 48 hrs instructing me to send back the drive which is a bit difficult since I am not in the US or Canada and the regional support has not been cooperative. So most probably will be buying another drive as it is the second time that a WD drive has failed on me.
